EB-1 : EMPLOYMENT BASED – The 1st PREFERENCE US GREEN CARD

EB-1 GREEN CARD DOES NOT REQUIRE A LABOR CERTIFICATE FROM SPONSOR / EMPLOYER.

1. EB-1 A: Extraordinary Ability

In the fields of Science, Art, Education, Business, Sports & gaining national & international recognition.

Meet at least 3 of the following criteria:

  1. Recipient of an internationally recognized major award or prize.
  2. Association members who need extraordinary achievements.
  3. There is publication of material about the subject in professional publications or trade media or other major media.
  4. As a judge on the work of others in the same or related field.
  5. Significantly contribute in the field of science, art, sports, or business.

  8. Holding a leading or important role for an organization or institution that has a respectable reputation

2. EB-1 B : Outstanding Professors & Reserchers :

Minimum 3 years of teaching in your area of expertise & have international achievements.

3. EB-1 C : Certain Multinational Manager or Executive:

You must have worked outside the United States for at least one of the last three years with your sponsoring employer. Your employer must meet certain requirements to be eligible to sponsor you.

EB-2 : EMPLOYMENT BASED – The 2nd PREFERENCE US GREEN CARD

EB-2 Green Card REQUIRES LABOR CERTIFICATE from Sponsor/Employer.

Processing time: 8-14 months.

Sub Category :

1. Advanced Degree

Minimum of a Bachelor's degree with at least 5 years post-baccalaureate, with progressive work experience, or a Master's degree. For a Doctorate: from the US or equivalent.

EB-2 NIW (National Interest Waiver) US GREEN CARD

Difference with EB-2:

EB-2 NIW DOES NOT require a LABOR CERTIFICATE / Sponsor, because your work is of NATIONAL INTEREST to the United States SELF PETITIONING with a Faster Process.

Processing time: 1-2 years.

Sub Category requirements: Same as EB-2

EB-3 EMPLOYMENT BASED – the 3rd PREFERENCE US GREEN CARD

Main Requirements (for all types of EB-3):

  • You need a JOB OFFER, where the Employer becomes your sponsor to get a Green card.
  • Employers must prove to the DOL (Department of Labor) that there is a shortage of similar workers in the US.

There are 3 categories:
Skilled Workers, Professionals, and Other Workers (Unskilled).

  1. Skilled Worker:
    • Minimum 2 years work experience or training in a relevant field.
    • Minimum education: Under Graduate Degree (D3 or S-1).
  2. Professional Worker:
    • Minimum Bachelor Degree (S-1) in a relevant field.
    • Work experience and education cannot be replaced by a degree.
  3. Others / Unskilled Workers:
    • INTERGERI focuses on EB-3 Unskilled.
      • Job options are provided, where the 'employer' is willing to sponsor you to get a Green card.
      • You must be willing to work at the company and in the job you have selected for a MINIMUM of 1 year.

  • Regular : 3-3.5 years

Can't wait in America, because tourist visas are a maximum of 6 months per visit.

EB-3 Visa Application Process (Unskilled / Other Workers):

This process requires the involvement of a US Immigration Attorney.

At the PRE ASSESSMENT Stage:

There is an online interview with the Consultant and the Employer. Your ability to communicate in English determines your success. Therefore, before the documents are submitted to the American Institution, the Employer must have AGREED to hire you. Only then does it proceed to the EB-3 Visa process.

There are 3 stages in the application:

1. PERM FILING STAGE (Permanent Labor Certification):

  • Submit documents to the Department of Labor (DoL) / American Department of Manpower:
    To obtain approval in the form of a LABOR CERTIFICATE (LC) for the EMPLOYER (not for the Applicant).
  • PERM: Electronic Review Management Program
    Process time: +/- 12-15 months.
    Applicants can check the application status at the link that will be provided after your files are submitted.
    PERM Submission Example
  • Please check your PRIORITY DATE The Priority Date is the date when the PERM Labor Certification application is filed with the US Department of Labor.
  • Check your case on the Department of Labor website: https://flag.dol.gov/case-status-search
  • After +/- 15 months from the Priority Date, the PERM document will receive approval.

Description:

  • FILING DATE : Priority Date.
  • DETERMINATION DATE: PERM Approval Date
  • EXPIRATION DATE: Expiration date
  • PERM Approval is valid (6 months from the time of approval)
  • Next, Submission to Phase II (USCIS) must be done before the Expiration Date.

2. SUBMIT PETITITION I-140 TO USCIS (United States Citizenship and Immigration Services)

Process time :

  • Regular : +/-12 months.
  • Premium : 1-2 months or less. Additional official fees to USCIS: $ 2,805 for main applicant.

3. CONSULAR PROCESISNG / ADJUSTMENT OF STATUS

  • A. Consular Processing (CP).
    1. If you register FROM OUTSIDE United States of America.
    2. Process time 3-6 months.
    3. Submit Form DS-260 to NVC (National Visa Center).
    4. The DS-260 application is usually made shortly after the I-140 is approved.
    5. After the Priority Date: Current (the date is the same as or exceeds the queue date listed in the Visa Bulletin), you will receive instructions for a Medical Check-Up (MCU) at a US Embassy referral hospital. The MCU applies to all family members, including children over 14 years of age.
    6. The MCU results are sent by the hospital directly to the American Embassy or Consulate.
    7. After that, there is an appointment for an interview at the American Embassy or Consulate, valid for all family members registered for the EB-3 Greencard.
    8. If the interview is successful, you will receive IMMIGRANT VISA, valid for 6 months. Within 3-4 months you must immediately leave for America to start working. If REJECTED : the EB-3 registration process is considered a failure.
    9. After arriving in America:

Inform your US Immigration Attorney of your Address.
GREEN CARD will be sent to your address.

Example of Immigrant Visa:

  • Adjustment of Status (AOS)
    • When you register when you PRESENT in the United States and have legal status with a Temporary Visa (Family Sponsored Visa, Work Visa, Student Visa etc). Tourist visa is not valid for this.
    • 9-12 month process.
    • Once your Priority Date is valid (as per the Visa Bulletin), a US Immigration Lawyer will file an AOS petition. (Form I-485) You and your family to USCIS, together.
    • You can apply for a Temporary Work Visa at the same time as applying for an AOS.
    • MCU is required, results are sent to USCIS.
    • Once AoS is approved, you will immediately receive GREEN CARD.

So the main difference between CONSULAR PROCESSING & ADJUSTMENT OF STATUS:

  1. Consular Processing:
    • If you register FROM OUTSIDE United States of America.
    • Receive your Immigrant Visa first. The Green Card will be issued after you arrived in America.
  2. Adjustment of Status:
    • When you register when you Located in the United States and have legal status with a Temporary Visa (Family Sponsored Visa, Work Visa, Student Visa etc). Tourist visa is not valid for this.
    • Get it right away GREEN CARD.

US GREEN CARD FAQ

1. Can parents sponsor their child to get an AMERICAN GREEN CARD?
If you:

  • Not yet a GREEN CARD holder: Can't.
    Parents can only sponsor children under 21 years old who are still dependent / studying / not married when applying for a Green card.
  • GREEN CARD Holder : Ability to
    F2A : Spouse & unmarried children < 21 years of Lawful Permanent Residents ( LPR ).
    F2B : Children > 21 years of age from LPR.
  • US Citizen : Ability to
    IR 2 (Immediate Relative): Children < 21 years old who live abroad.
    F1 : Children > 21 years of age of US Citizens, who are not married.
    F3 : Children (Sons & Daughters) of married US Citizens.

2. Can a child sponsor a parent to register for the American GREEN CARD?
If you:

  • Green Card Holder : Can't.
  • US Citizen : Yes, you must be at least 21 years old, with proof of financial sufficiency.

    Process: 12-18 months.

What is VISA BULLETIN in the AMERICAN GREEN CARD application process?

Visa Bulletin A document published monthly by the US Department of States – Bureau of Consular Affairs (American Ministry of Foreign Affairs) that provides information related to Visa Quota Limit and Processing Date for immigrant visa / Green card type categories:

  • Family Sponsored References.
  • Employment-Based Preferences.
  • Diversity Visa/Lottery Greencard.

There are 2 main parts:

A. Final Action Dates

The date indicating when a Greencard applicant can proceed to the next stage, such as an interview at the embassy or filing Adjustment of Status (AOS) in the country.
If Priority Date applicants earlier than the date listed in this section, then applicants can continue their visa application process.

Priority Date:

  • The date the PERM Labor Certification application was submitted to the Department of Labor.
  • The date used for determine the processing order in the Immigrant Visa / Greencard queuing system. This date determines how quickly a person can continue their immigration process.

B. Dates for Filing

The date indicating when Greencard applicants can apply for Adjustment of Status or applying for an immigrant visa abroad, even if the visa is not yet available.
Typically, this date is earlier than the “Final Action Dates,” giving applicants the opportunity to start some parts of the process sooner. Visa Categories and Country of origin which has a limited quota.

This is because number of visas per category awarded each year is limited, and some countries may have higher demand than others, resulting in waiting times of years.
Visa Bulletin It is very important for visa applicants affected by the quota system, as it provides guidance on when they can proceed to the next stage of the immigration process based on priority and visa availability.

What is H-1B Visa (America)

H1-B is a

  • Work Permit / Visa = NON IMMIGRANT VISA, not Green card / Immigrant Visa.
  • Only valid at 1 sponsor company.
  • There is an Annual quota, this year 65,000 Visas for regular applicants
  • Plus 20,000 for those with a minimum of a Master's degree.
  • Specialty Occupation: engineers, doctors, data analysts, computer programmers, scientists,
  • Minimum Bachelor's degree or three years of work experience is considered equivalent to one year of Bachelor's work.
  • Spouses and children under 21 of H-1B holders can live in the US on H-4 visas but are generally not granted work authorization, except in certain situations.

Disadvantages of the H-1 B Visa;

  • LOTTERY / Draw system, because the number of registrants far exceeds the quota
    Even if you/your child is an American graduate, there is no guarantee of getting an H-1B visa.
  • THERE IS A TIME LIMIT, Maximum 6 Years.
    You can stay in America if:
    • Successfully get an Employer to sponsor you.
    • Successfully apply for a Greencard, either with EB-1, EB-2, EB-3 or EB-5

Can I register for GREEN CARD if I am in the process of applying for ASYLUM?

If a person is still in the process of applying for asylum and not yet accepted as ASYLEE, they are generally cannot immediately apply for a Green Card, unless there are certain conditions.
While waiting, you are given a Work Permit and SSN (Social Security Number) so you can work in America legally.
After having ASYLEE status, you need to:

  1. Wait 1 year, before applying for Green card.
  2. Apply for AoS (Adjustment of Status) via Form I-485.
  3. Submit documents:
    • Proof of Asylee Status,
    • Identification Documents
    • Proof of Employment
    • MCU, etc.

WARNING!!  Discuss your case with a US Immigration Attorney.
Is it possible for the head of the family to register for US GREEN CARD first, and for his wife and children to be registered?

  • It is best to apply for a US Green card in one application so that they can be processed simultaneously.
  • After the interview at the Embassy, your IMMIGRANT VISA will be affixed to your passport, valid for 6 months.
  • Have to go to America.
  • If your child still has to continue school, you can't move straight away, and your wife has to accompany your children, then:
    • Berangkat dulu ke Amerika dan melapor di Imigrasi Bandara setempat
    • Then inform your address to your lawyer, so that the 'Green card' card will be sent to your address.
  • Meet your lawyer for drafting REENTRY PERMIT, by filling out Form I-131, for his wife and children who will return to Indonesia.
  • Reentry Permit usually valid for 2 years, and if necessary, can be extended again with good reason.
  • If you also need a REENTRY PERMIT, because you cannot leave your job, etc, discuss it with your US Immigration Attorney.
  • It is best to discuss family relocation plans with a US Immigration Attorney BEFORE you apply for a Green card.

IMPORTANT: Pay attention to your child's age limit.

If under 21 years old (category F2A): process +/- 3 years.
Age > 21 years (F2B): the process can take up to 10 years.
